Appeals court finds against Mayagüez mayor

The San Juan Court of Appeals on Wednesday dismissed the appeals filed by suspended Mayagüez Mayor José Guillermo Rodríguez and the western coastal municipality’s former finance director, Yahaira Valentín, on the validity of the proceedings against them during a Rule 6 hearing.


The case is being handled by independent special prosecutors Leticia Pabón Ortiz and Ileana Agudo Calderón.


The appellate panel was composed of Judge Ortiz Flores, Judge Candelaria Rosa and Judge Brignoni Mártir, who was the judge who filed the decision. The court concluded that neither Rodríguez nor Valentín were able to rebut the presumption of correctness of the determination of probable cause to charge.


The panel also determined that neither case meets the regulatory criteria necessary to issue the writ of certiorari and change the determination of the cause of action for trial by the trial court.
