Corrections Dept. rejects transfer of defendant in fatal stabbing to juvenile facility

The Department of Corrections and Rehabilitation (DCR by its initials in Spanish) has recommended to the Aibonito Court that 17-year-old Anthonieska Avilés Cabrera, who is charged along with her mother, Elvia Cabrera Rivera, in the stabbing death of 16-year-old Gabriela Nicole Pratts Rosario, remain incarcerated in the Bayamón prison rather than being placed in a juvenile facility, as her defense team has requested.


Judge Marielem Padilla Cotto has asked the DCR to provide a structured plan outlining the living conditions for the minor. The plan should include details on recreational activities (both passive and active), and education, health and safety measures. The plan must be submitted by next Friday before a decision can be made.


The preliminary hearing for Cabrera Rivera and Avilés Cabrera is scheduled for Sept. 18

A judge in August found probable cause to arrest the two on charges related to the brutal stabbing death of Pratts Rosario in Aibonito on Aug. 11.


Both will be tried for first-degree murder and violating the Weapons Law under common and mutual agreement. Bail was set at $1 million each. Notably, the minor will be tried as an adult, with both defendants facing up to 99 years in prison if convicted.
