Lawmaker files 2 bills to adapt evidentiary procedures to impact of AI

In a step toward adapting Puerto Rico’s justice system to the new realities presented by the use of artificial intelligence (AI) algorithms, House Judiciary Committee Chairman José “Ché” Pérez Cordero on Wednesday introduced House Bill (HB) 1098, which establishes that disputes over evidence created or manipulated with generative AI must be part of the preliminary report between lawyers.


“The increasing use of generative AI has raised questions about the viability of the legal system, at both the federal and state levels, to address the authentication and admissibility of evidence that may have been created or manipulated using these algorithms,” the at-large lawmaker said. “On August 1, 2025, a Louisiana state law went into effect amending its rules of civil procedure to address this. This measure we are introducing establishes that disputes over evidence created or manipulated with AI must be included in the preliminary brief between attorneys.”


Pérez Cordero also filed HB 1099, which seeks to amend Puerto Rico’s rules of evidence. The legislation establishes the privilege for journalists not to disclose their sources or confidential information, proposes to clarify when the prosecution must justify the character evidence it intends to present, and clarifies that the jury may only hear hearsay evidence. It also requires a sworn statement instead of a certification from the custodian of the evidence or a qualified witness, among other changes.


Pérez Cordero stressed that “it is necessary for the Puerto Rican legal system to continue adapting to rapid technological evolution.”


The House Judiciary Committee urged interested parties to submit briefs on the two measures under consideration.
