House panel gives entities 10 days to submit documents on Power Expectations contract

The House of Representatives’ Government Committee has granted a 10-day deadline to four energy sector entities to submit documents regarding the evaluation, negotiation and approval of contract 2026-P0010 with Power Expectations for temporary power generation.

The requests, sent earlier this week, are directed at the Puerto Rico Electric Power Authority (PREPA), the Public-Private Partnerships Authority (P3A), the Independent Procurement Office (known as 3PPO), and the Puerto Rico Energy Bureau. The investigation is being conducted under House Resolution 42.

“Puerto Rico wants clarity on this matter; that is why we are allowing 10 days -- starting yesterday -- for PREPA, P3A, 3PPO, and the Energy Bureau to provide us with detailed information regarding everything related to the contracting of Power Expectations LLC,” Rep. Víctor Parés Otero, the committee chairman, said in a written statement.

The committee requested all communications, emails, text messages, and letters exchanged between officials or representatives of the government entities and Power Expectations, Enchanted Rock, ERock, Reyes Contractor Group, or Flotek Industries regarding the contracting process.

The request also covers communications among PREPA, the P3A and 3PPO concerning the financial, technical and operational capacity of the companies that formed the consortium.

The committee asked for analyses, memoranda, legal opinions, and internal or external consultant reports regarding the financial, technical and legal viability of the contract. The request includes documents related to the interconnection agreement signed with LUMA Energy on Aug. 3 of this year.

The entities must identify the officials and employees who participated in the evaluation, negotiation, approval, or signing of the contract and in the preceding competitive process. They will also be required to submit copies of the conditional approval dated July 4, 2025, and the approval dated Dec. 11, 2025, regarding the TPG2 temporary generation process.

Parés Otero linked the investigation to the referral that -- as he noted -- P3A Executive Director and Energy Czar Josué Colón Ortiz sent to the island Justice Department on Aug. 10 concerning allegations of unauthorized use of Enchanted Rock’s name and signature during the contracting process.

The legislator added that the request also stems from the Financial Oversight and Management Board’s decision to withdraw its endorsement of the contract, deeming it “irreparably flawed.”
